  1. Subject of the general terms

These general terms ("Terms") regulate the conditions for the use of the website and online store for art materials and supplies at the internet address with domain https://arthdecor.com/ and regulate the relations between the owner and administrator of the website "ART HOME AND DECOR" LTD ("Art Home & Decor", "We", "The Company", "The Merchant") and any person who has visited the website or placed an order through the online store, hereinafter referred to as "User".
    • By using the website and online store https://arthdecor.com/You declare that you have read and agree to comply with these terms, and that you are of legal age and have the capacity to enter into a binding contract with us. If you do not agree with them, you should refrain from using the website.

  • Rights when using the website and online store
  • Website and online store https://arthdecor.com/ provide users the opportunity to conclude distance sales contracts and delivery of art materials, epoxy resins, and consumables, including the following:
  • To view the goods in the catalog, described with their main characteristics and price;
  • To make inquiries through the contact form on the website;
  • To search for products by categories and various criteria;
  • To register a user profile from which they can view their orders, manage billing and shipping addresses, and change their password and profile information;
  • To conclude distance purchase and sale contracts and delivery of art materials, epoxy resins, and consumables;
  • To make payments related to the concluded distance purchase and sale contracts;
  • To read articles and guides on the website's blog;
  • To receive promotions and discounts.
  • User profile registration
  • User profile registration is done by entering an email address and password and includes details of recent orders, management of billing and shipping addresses.
    • Registration allows the user to place an order and delivery of products from the online store. Upon completing each online order, the user declares that they accept and agree to comply with these general terms and conditions.
    • The user can use the online store services as an unregistered user by entering the required data for order shipment.
    • The user is responsible for entering accurate and complete information in their profile, as well as for its updating. When creating a profile, the user agrees that the merchant will process their personal data in accordance with the privacy policy published on the website.
    • The user is responsible for maintaining the confidentiality of their username and password. By registering on the website, they declare that they are responsible for all activities carried out from their profile.
    • We reserve the right to provide part of the website content exclusively to registered users by marking the content as restricted use.
  • Online order and delivery
  • The user can add selected goods to a virtual cart by clicking the "Add" button on the respective product page. They can freely browse the contents of the cart, add new products, or remove those they do not want.
    • By clicking the "Checkout" button, the user's contact details and delivery information according to the proposed options appear. The order is completed by clicking the "Order" button. At any time before completing the order, the user has the right to change the selected goods.
    • Upon completion of a specific order on the website, the user receives a confirmation email and enters into a contractual relationship with the merchant.
    • If the merchant cannot fulfill the order due to stock depletion or other technical reasons, they are obliged to notify the user by email or phone and refund any amounts paid, if any. In these cases, the merchant is not liable as long as they have informed the user of the circumstances.
    • On the page of each product in the online store, the price, main characteristics, and additional information about the product are indicated to assist in the purchase decision. The merchant is not responsible for inaccuracies in the product description and does not guarantee the completeness of the provided information.
  • Delivery time
  • Ordered online goods are delivered by the courier company "Econt Express" AD to the courier's office or to the customer's address, as well as to BOX NOW lockers throughout the country.
    • The delivery time for the goods is from 3 to 5 working days, starting from the date the order is completed by the user through the merchant's website and confirmation is received by email.
    • The delivery of the ordered goods is carried out in the manner chosen by the user, and the merchant has the right to extend the specified deadlines up to 7 working days, for which the user will be notified in a timely manner.
    • The delivery price is determined by the courier companies we work with, according to the terms and rates of the courier services, and is at the user's expense.
    • The merchant reserves the right to change the subcontractors performing the delivery without prior notice to the user, provided that this does not change the method of delivery.
  • Payment for purchased goods

Goods ordered from the website can be paid by the buyer via cash on delivery with courier or by bank transfer.

  • When paying by cash on delivery with courier, the buyer hands over the full amount due in cash upon delivery, and the courier is obliged to transfer the amount to the merchant on their behalf and for their account.
  • When paying by bank transfer, the user deposits the value of the order into the merchant's bank account, indicating the order number as a reference. After the transfer is confirmed, the ordered goods are delivered.
  1. Goods complaints
  • The user can make a complaint about a purchased good according to Article 122 and following of the Consumer Protection Act by bringing the goods to the Art Home & Decor store for verification of the non-conformity or defect of the goods along with all accompanying documents.
    • The merchant's address for submitting complaints is: Varna, Vladislav Varnenchik residential complex, block 11, ground floor.
    • For online purchases, the consumer must send the goods from an Econt Express courier office to the office from which the merchant sent them, namely: Econt Office, Troševo residential complex, Varna, along with the full set of documents including a written complaint request, receipt, invoice, warranty card, etc.
    • The statutory warranty for all goods is 2 years, starting from the moment the goods are delivered in accordance with the Law on the Provision of Digital Content and Digital Services and the Sale of Goods /LPDCDS/.
  1. Exercising the right of withdrawal for online purchases
  1. The consumer has the right to withdraw from an ordered online product without giving a reason and without owing compensation or penalty, within 14 days from the receipt of the goods, provided that the goods are in the condition in which they were delivered and the commercial appearance of the goods and packaging is not violated.
  2. To exercise the right of withdrawal, the consumer must notify us of their decision by mail or email using the standard withdrawal form – Appendix 1, published at the bottom of these general terms and conditions.
  3. Потребителят следва да върне обратно стоката без неоправдано забавяне не по-късно от 14 (четиринадесет) дни от деня, в който е уведомил дружеството за отказа си от поръчката. При връщане на стоката, потребителят следва да изпрати и пълния комплект документи вкл. касов бон, фактура, приемо-предавателен протокол, гаранционна карта и др.Когато потребителят е упражнил правото си на отказ от онлайн поръчка, търговецът възстановява всички суми, получени от потребителя, без неоправдано забавяне и не по-късно от 14 дни, считано от датата, на която е бил уведомен за решението на потребителя да се откаже от договора.Търговецът има право да отложи възстановяване на плащанията до получаване на стоката обратно или докато потребителят представи доказателства, че е изпратил обратно стоката, в зависимост от това кое от двете събития е настъпило по-рано.При приемане на върната стока търговецът има право да провери за щети, причинени от необичайно ползване от страна на потребителя. При наличие и установяване на щети като счупване, надраскване и други въздействия, ние ще направим прихващане от сумата за възстановяване, съобразно оценката на констатираната щета и съгласно чл. 55 ал.4 от ЗЗП.Ние ще възстановим получените суми, като използваме същото платежно средство, използвано от Вас при първоначалната транзакция, освен ако сте изразили изричното си съгласие за използване на друго платежно средство и при условие, че това не е свързано с разходи за Вас.Разходите за връщането на стоката при отказ са за сметка на потребителя на основание чл. 55, ал. 2 от ЗЗП.
  4. These withdrawal rules do not apply to the purchase of goods from a physical store.
  1. Prices
  1. The merchant places the selling price of the goods in a visible place in close proximity to them. The selling prices of goods offered through catalogs and through the online store are indicated next to the picture or description of the goods.
  2. All indicated prices of the goods are in Bulgarian lev with all taxes and fees included. The indication of prices in euros is carried out in accordance with the provisions of the Law on the Introduction of the Euro in the Republic of Bulgaria regarding the obligation and period for dual pricing of goods and services. The final price of each product is determined by the merchant on the page of the respective product in the online store.
  3. The merchant has the right to change the prices of the goods at any time without prior notice, with the changes applying going forward and not affecting already made orders.
  4. The consumer is obliged to pay the price that was indicated at the time of purchase from the commercial establishment or the order from the online store, regardless of whether it is lower or higher than the current one. In case of technical errors in the price, the merchant has the right to refuse to fulfill the order and does not owe compensation to the consumer, except for the refund of paid amounts, if any.
  1. Promotions and discounts
  1. The merchant organizes promotional campaigns for the offered goods, valid for a specified period indicated in each campaign.
    • The announcement of reduced prices is made by placing the new price next to the old one, which is crossed out. If no validity period for the discount is specified, the new price applies until stocks are exhausted, but no more than 30 calendar days from the moment of its announcement.
    • In case of suspicion of abuse of the terms of promotional campaigns and promo codes, the merchant reserves the right to refuse order fulfillment to users.
  1. Intellectual Property Rights

All intellectual property rights are its property, and any unauthorized use may constitute a violation of copyright, related rights, or other rights protected under the Copyright and Related Rights Act of the Republic of Bulgaria.
    • Users have the right to use the materials (including information, photos, videos) on the website only for personal, non-commercial use, provided that the copyrights of the owner or third parties are not violated.

The general terms and conditions in force at the time of concluding the distance sales contract between the client and the merchant apply to each purchase through the online store.
    • For all matters not regulated by these General Terms and Conditions, the provisions of the applicable legislation of the Republic of Bulgaria shall apply.
